“No more domestic abuse” – Indian government

The Protection of Women from Domestic Violence Act 2005 comes into effect Thursday in India.

According to estimates, about 70% of women in India were victims of domestic abuse in some form

Under this law, domestic violence offenders can be jailed for a maximum of one year or fined up to Rs 20,000, or both.

The new law provides an all-encompassing definition of domestic violence  including not only physical violence by the husband, such as beating or physically hurting his wife, or sexual violence like forced intercourse, but also verbal or emotional violence such as insulting the wife or preventing her from taking up a job, and even economic violence such as not allowing the wife to use her salary.

While I commend the government’s intentions with both this law and the law to prevent child labor, I wonder about how the government is going to make it work?. Does the government have the necessary power and will to implement and maintain these laws ? Or is this just lip-service to be made effective and then forgotten or wilfully disobeyed like most other laws in India?

Only time will tell……

  1. I applaud the intention, but I, unfortunately, have a really hard time believing it will be enforced adequately. There has to be a huge shift in culture, and this is a great first step.

  2. I am skeptical, too.Will the government give it the funds it deserves? Will women report abuse? After all, to report abuse means having to go public with it, something many Indian women are loathe to do. Still, I am just glad there is a law, it’s long overdue. From what I have read this law protects women from spousal abuse…what about abuse suffered at the hands of a mother-in-law?

  3. Hi Hindu Mommy. I like reading your blog very much. I do not know a great deal about Hindu life but I do believe that ALL women should be treated with respect, love and kindness. In this wide world we have mostly come last. Even in the US we have had to fight for every ounce of freedom we have gained and for any rights we might have.
    I wish that this could be the begining for all the women of the world.

  4. Though I wholeheartedly support any law which prevents domestic violence, I feel that the law should protect women as well as men. The way the law has been drafted lends it to severe misuse, very similar to the misuse of the dowry law (498a) in India.

    @LotusReads – u bring up a good point about MILs…they are probably responsible for as much or more violence than the husbands

    @Givemejustice – agree we should protect women as men…but unfortunately in India, more women are mistreated than men – that’s why we have a specific law against that

  6. This is the most Fascist one-sides law which will torment the innocent men, their mother and sisters.

    Women are driving 22,000 men to suicide every year and go scot free.

  7. Sumanth: No arguing that there are women who give hell to men and they should also be given their due justice.
    But in india, more women are mistreated and are the weaker sex (however much I hate to use that term – it’s true) so the law is there to protect them

    Fine. Does that mean the state picks up innocent people (young and old and even women) and put them all in Jail?

    Give us the facts that women are worse off in Indian society than men.

    Use statistics of suicide for both gender, murder and depression.

    Lets talk facts, and not some generic statements.

    Men and boys are disposable. Women supress the emotions of their sons by forcing them not to cry at age of 5. Then they use them as unpaid bodyguards,”Beta, please go with aunty till her house in next street.”

    The aunty may be is a 30 year old fat creature and yet a 10-year old boy has to work as an unpaid bodyguard. I myself worked as a unpaid bodyguard appointed by my FEMINIST mother. Today, my feminist mother paid the price when the father of her daughter-in-law used all kind of abusive language against her and there was no law to protect her.

    I really enjoyed it.

    Indian Judiciary in dysfunctional. Sita will not use this law. Only child-killer Surpanakhas and Kaikeyis will use it. Soon no man will marry and society will go to Live-in like Ireland, Germany, Taiwan.

    Men and also women will sleep with 500 partners before even thinking of marriage.
